Form 1099-NEC, Nonemployee Compensation, is an IRS information return used by payers to report certain payments for services to people who are not employees. The current form is the December 2026 revision, intended first for amounts reportable for calendar year 2026, with the first IRS filings for those amounts beginning in January 2027.
This timing is important because the IRS releases some information returns before the filing season in which issuers first send them to the IRS. The revision year, payment year, and filing year therefore need to be read together.
Who Uses Form 1099-NEC?
Businesses and other payers use Form 1099-NEC when the applicable IRS reporting rules are met for nonemployee compensation. Current IRS guidance generally looks for payments made in the course of a trade or business for services performed by someone who is not an employee, along with the entity-type and threshold rules in the instructions.
For payments made during 2026, current IRS guidance sets the general nonemployee-compensation reporting threshold at $2,000, increased from the $600 threshold applicable to payments made before 2026. Backup withholding can trigger reporting regardless of the payment amount, and special payment categories have their own rules.
What Does the 2026 Form 1099-NEC Report?
The December 2026 form reports nonemployee compensation and contains additional boxes required under current law. The recipient instructions explain how reported amounts can interact with self-employment income, qualified tips, qualified overtime compensation, backup withholding, and other tax items when applicable.
A recipient should not assume every amount on Form 1099-NEC automatically belongs on Schedule C. If the amount is self-employment income of a sole proprietor, Schedule C may be appropriate. The form’s recipient instructions also note that some nonemployee compensation from a sporadic activity or hobby may be reported differently.
2026 Form 1099-NEC Filing Deadline
The IRS instructions require Form 1099-NEC to be filed by January 31 using either paper or electronic filing procedures. When that date falls on a Saturday, Sunday, or applicable legal holiday, the deadline moves to the next business day.
For calendar-year 2026 reporting, January 31, 2027 falls on a Sunday, so the normal next-business-day rule applies. Payers should verify the IRS filing calendar before the deadline in case special relief applies.
Recipient Copy Deadline
Form 1099-NEC is also furnished to the recipient. Publication 1099 lists January 31 as the standard recipient-statement deadline for Form 1099-NEC, subject to the same general weekend and holiday timing rules.
Do Not Print and File Copy A From the IRS PDF
The IRS PDF contains an important warning about Copy A. The red Copy A displayed in the downloadable PDF is provided for informational purposes; a self-printed Copy A is not scannable in the same way as an official IRS information-return form. The IRS warns not to print and file that Copy A from the PDF.
Copies intended for the recipient can be printed as allowed by the form instructions. For IRS filing, use an approved electronic filing system or official scannable forms when paper filing is permitted.
Electronic Filing and the 10-Return Threshold
The 2026 form notes that filers with 10 or more information returns in the aggregate may be required to e-file information returns. The IRS provides its Information Returns Intake System (IRIS) for electronic filing. The aggregation rule can involve multiple information-return types, so review Publication 1099 rather than counting only Form 1099-NEC.
How Form 1099-NEC Affects the Recipient
A Form 1099-NEC is an information statement, not a tax return by itself. The recipient includes the payment in the proper place on the recipient’s federal return based on what the payment represents.
For a sole proprietor, reportable self-employment income can be included with business income on Schedule C. Schedule C should reflect all taxable business receipts required to be reported, not only amounts for which an information return was received. A person may have taxable business income even if no Form 1099-NEC was issued.
Correcting Form 1099-NEC
The IRS general information-return instructions provide correction procedures for incorrect payee information, taxpayer identification information, payment amounts, and other errors. The process depends on the type of error and whether the original return was filed on paper or electronically.
